TERMS OF SERVICE

These Terms of Service (“Agreement”) explain the working relationship between you (“Client,” “you,” or “your”) and Pixel Crew Media (“Company,” “we,” “us,” or “our”). They are designed to be clear, fair, and straightforward, outlining what you can expect from us and what we need from you. This Agreement governs all photography, videography, drone, 3D scanning, floor plan, and related media services (collectively, the “Services”) provided by Pixel Crew Media.

By scheduling, ordering, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. COMPANY INFORMATION & SERVICE AREA

Pixel Crew Media is a media company operating primarily within a fifty (50) mile radius of Nashville, Tennessee. Services outside this service area are not offered unless expressly approved in writing by Pixel Crew Media.

2. APPOINTMENT SCHEDULING & PROPERTY READINESS

To help your listing look its absolute best, we ask that the property be fully prepared before our arrival. This ensures a smooth appointment and avoids unnecessary delays or return visits.

2.1. The Client is responsible for ensuring the property is clean, staged (if applicable), accessible, and ready to be photographed or filmed at the scheduled appointment time.

2.2. Pixel Crew Media does not provide cleaning, staging, decluttering, furniture rearrangement, or property preparation services. However, we’ll always do a final walk thru to make sure a property looks its best.

2.3. If the property is not ready at the scheduled appointment time, Pixel Crew Media may, at its discretion:

(a)  Proceed with the Services as-is; or

(b)  Reschedule the appointment.

2.4. If an appointment must be rescheduled or canceled due to property unreadiness, the Client may be charged up to one hundred percent (100%) of the invoiced amount, depending on time and resources already committed.

Our team will always communicate clearly on-site, and whenever possible, we’ll work with you to find the least disruptive solution.

3. CANCELLATIONS, RESCHEDULING, & WEATHER

We understand that real estate schedules change and that weather can be unpredictable. Our goal is always to work with you to find the best possible solution while being respectful of our team’s time and resources.

3.1. Appointments may be canceled or rescheduled without penalty if notice is provided at least one (1) business day prior to the scheduled appointment.

3.2. Same-day cancellations, no-shows, or cancellations made on-site may result in a cancellation fee equal to one hundred percent (100%) of the total invoice, as time and resources have already been allocated.

3.3. Weather-related rescheduling is permitted when conditions would materially impact safety or quality, including heavy rain, standing moisture, snow, ice, or hazardous wind. Cloudy or overcast conditions alone do not automatically qualify for penalty-free rescheduling.

If you are unsure whether weather conditions warrant a reschedule, we encourage you to reach out—we’re here to help and will always do our best to advise you fairly and professionally.

4. TRAVEL FEES

4.1. Pixel Crew Media does not charge travel fees for properties located within thirty-nine and nine-tenths (39.9) miles of the assigned photographer’s starting location.

4.2. Travel fees apply as follows:

·      Properties located 40.0 to 44.9 miles from the photographer: $25 travel fee

·      Properties located 45.0 to 50.0 miles from the photographer: $50 travel fee

4.3. Distance is calculated one-way from the photographer’s starting location to the property address.

4.4. Properties located beyond fifty (50) miles are outside the Company’s service area and require prior written approval and a custom quote.

5. TURNAROUND TIME & DELIVERY

Fast, reliable delivery is important—especially in competitive real estate markets. We build our turnaround times to support agents working on tight timelines.

5.1. Standard turnaround times are as follows, excluding weekends and holidays:

·      Photography: Next business day delivery

·      Video and other media services: Up to three (3) business days

5.2. Turnaround times are estimates, not guarantees, and may be affected by weather, technical issues, or circumstances beyond our reasonable control.

5.3. Rush delivery may be available for an additional fee if requested and approved in advance.

If you have a deadline or special circumstance, let us know—we’ll do our best to accommodate whenever possible.

6. COPYRIGHT & USAGE LICENSE

6.1. All photographs, videos, and other media produced by Pixel Crew Media remain the exclusive intellectual property of Pixel Crew Media.

6.2. Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the delivered media solely for the marketing and promotion of the specific property for which the Services were performed.

6.3. Permitted use includes MLS listings, brokerage websites, social media, and other property marketing platforms.

6.4. The license granted herein does not permit use by third parties, including but not limited to builders, designers, stagers, or other agents, without prior written consent from Pixel Crew Media.

6.5. Media may not be sold, sublicensed, altered for resale, or used in any manner not expressly permitted under this Agreement.

7. EDITING & REVISIONS

7.1. Standard editing is included in the Services.

7.2. Additional or extensive editing requests, including re-edits after delivery, compositing, or special effects, may incur additional fees starting at $50, subject to approval.

8. PAYMENT TERMS

8.1. Full payment is due prior to the release or download of any media.

8.2. Pixel Crew Media reserves the right to withhold delivery of Services until payment is received in full.

8.3. Once Services have been rendered, orders may not be reduced or refunded.

8.4. Outstanding balances may be applied to future invoices or services.

8.5  Overdue payments are subject to a $25/week late fee at our discretion.

8.6  Payments overdue past a month are subject to an additional $100/month or 10%/month late fee at our discretion.

8.7  Booking a service with us means you agree and understand the payment schedule on your quote/order and the applicable late fees for non-payment.

8.8  In the event the bill goes without payment for more than 4 weeks, your brokerage office will be contacted and informed of the outstanding balance to a vendor.

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by law, Pixel Crew Media is not responsible for indirect or consequential damages, including loss of profits, missed marketing opportunities, or listing delays.

9.2. Pixel Crew Media shall not be responsible for issues arising from property condition, access limitations, third-party actions, or circumstances beyond its reasonable control.

10. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

12. ENTIRE AGREEMENT & CLIENT ACKNOWLEDGMENT

This Agreement constitutes the entire agreement between the parties regarding the Services and supersedes all prior agreements, representations, or understandings, whether written or oral.
